Eyrus Terms

General Terms

Eyrus customers are subject to these general contract terms + our privacy policy.

Payment

  • Payment can be made by Credit card or ACH payment only 
  • Payments are due as follows:
    • The hardware & set-up total and any optional services are due upon Notice-to-Proceed.
    • Monthly subscription fees are paid annually in advance.
    • Invoice payment is due within 30 days. Please be advised that we will charge 1.5% interest per month on late invoices.
  • Monthly subscription increases to $175/Month for any additional BLE and NFC readers.
  • Pricing does not include shipping & handling 
  • Additional Eyrus hardware is available at the designated unit price plus shipping + $30 handling fee per order. 
  • Expedited shipping available for hardware at additional costs based on client requests. 
  • All payments are without retention.
  • Cancelation of Eyrus services after the minimum term requires a 30-day notice.
  • Proposal pricing expires after 60 days from date of this proposal.
  • Eyrus will rectify any turnstile issues within 72 hours

Project Set Up

Eyrus Responsibilities:

  • Create project in the Eyrus database.
  • Integrate project webcam links (if available) to display on Eyrus dashboard.
  • Link GPS coordinates to the project and incorporate weather reports.
  • Incorporate all critical project dates and information.
  • Provide online training to client on-site POC and support him/her as needed with registration and data management throughout the project.
  • The on-site POC and Eyrus will establish a project workforce registration protocol.

Client Responsibilities:

  • Designate an on-site POC to coordinate with the Eyrus team.
  • Define team members roles and permissions and provide access as agreed.

Workforce Registration:

  • All registration devices (beacons, badges, cards, or combo badges) will be shipped as needed.
  • All orders are a minimum of 250 batches.
  • Eyrus will provide continuous remote support and assistance as needed by client.

Eyrus Visibility App

Eyrus Responsibilities:

  • Support and train the client POC for on-site use of the Eyrus Visibility app. 
  • Provide remote technical support as necessary.

Client Responsibilities:

  • Apple ipad or iphone running iOS 14 or higher required for app use. iPhone models that support NFC (iPhone SE or later) are necessary for using the Visibility app with Eyrus NFC cards; ipads do not support NFC. Any iphone or ipad running the required iOS with bluetooth enabled will support Eyrus BLE badges. 
  • Android phone or tablet running Android 7.0 and up. Models that support NFC are necessary when used with Eyrus NFC cards. Any device running required OS with Bluetooth enabled will support Eyrus BLE badges.
  • Eyrus client responsible for strict enforcement of the workforce to enter/exit through the designated entrances with the selected Eyrus wearables for accurate data collection on site. 
  • Optional: For a pre-specified fee, Eyrus personnel will travel to support and train in person.

SMS/Text Messaging Terms

This section applies to all SMS and MMS text messaging communications sent through the Eyrus platform, including messages sent by Eyrus AI, Eyrus Assistant, and Eyrus Len: AI Assistant. This also applies to SMS used for customer support via zendesk or other contracted support platform.

SMS Use of Contact Information for Support

By providing your contact information, you consent to receive support-related communications via SMS, phone, or email from Eyrus. Message and data rates may apply. Reply STOP to opt out.

SMS Program Description

Eyrus provides SMS and MMS messaging services to deliver construction site communications to authorized project contacts. Message types include:

  • Daily site reports and workforce summaries
  • Headcount updates and trade breakdowns
  • Safety alerts and weather notifications
  • Fatigue and compliance alerts
  • Workforce analytics and labor hour summaries
  • Responses to project data inquiries
  • Opt-in confirmations and service messages

SMS Consent and Enrollment

By providing your mobile phone number to the Eyrus platform — or by being added as a project contact by

an authorized site administrator — you may receive a one-time opt-in confirmation message. You must

affirmatively reply YES to the opt-in confirmation message before any additional messages will be

sent to you. Your consent to receive messages is not a condition of purchasing any goods or services.

SMS Message Frequency

Message frequency varies based on your project's configuration. Site administrators set alert rules and

report schedules per project. Typical volume is 1 to 10 messages per week, though frequency may

increase during active construction periods or safety events.

SMS Message and Data Rates

Standard message and data rates may apply. Charges depend on your mobile carrier and plan. Eyrus is

not responsible for any fees charged by your wireless provider.

SMS Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message received from

Eyrus. You will receive a single confirmation message acknowledging your opt-out. After opting out, you will

no longer receive text messages from the Eyrus platform for that project. You may also contact us at

SMS Supported Carriers

Eyrus messaging is supported on all major U.S. carriers, including but not limited to AT&T, Verizon, TMobile, and Sprint. Carriers are not liable for delayed or undelivered messages.

SMS No Warranty on Delivery

Eyrus does not guarantee message delivery. Delivery is subject to effective transmission by your mobile

carrier. T-Mobile is not liable for delayed or undelivered messages.

SMS Privacy

Information collected through SMS messaging (including phone numbers and message content) is

governed by our Privacy Policy. We do not sell, rent, or share your phone number or messaging opt-in data

with third parties for their marketing purposes. Phone numbers and opt-in consent are used solely for the

purpose of delivering Eyrus project communications.
